What Constitutes Drug Manufacturing Under California Law

Health and Safety Code section 11379.6 makes it a felony to compound, convert, manufacture, derive, process, or prepare any controlled substance listed under HS sections 11054 through 11058, whether through chemical extraction or chemical synthesis. Substances commonly associated with manufacturing charges include methamphetamine, PCP, MDMA, crack cocaine, LSD, and heroin.

One important statutory detail: the manufacturing process must have actually begun. Assembling precursor chemicals alone may not satisfy the threshold, though possession of certain precursor chemicals can trigger separate charges. The law also reaches beyond the primary manufacturer. Anyone who offers to assist or actively participates in the production process can face the same charge.

Penalties & Sentencing Enhancements Under HS 11379.6

A base conviction under HS 11379.6 carries three, five, or seven years in California state prison and a fine of up to $50,000. Sentencing enhancements can push those numbers significantly higher:

  • Child present: An additional two consecutive years if a minor under 16 was present in the manufacturing location
  • Child injured: Five additional years if a minor under 16 was seriously injured as a result
  • Other injuries or deaths: One additional consecutive year per person harmed during manufacturing
  • Quantity enhancements: Three extra years for more than three liters of liquid or one pound of solid; five extra years for more than 10 gallons or three pounds; up to 15 additional years for larger quantities
  • Prior convictions: Three additional years per prior drug-related conviction

If the operation involves interstate commerce or federal controlled substance statutes, federal charges may be added on top of state prosecution. Beyond imprisonment, a felony conviction under HS 11379.6 can affect immigration status, professional licenses, and the right to own firearms.

Defense Strategies in Drug Manufacturing Cases
