Felony Penal Code Section 524 – Attempted Extortion and Misdemeanor Penal Code Section 422 – Criminal Threats, Vacated, Dismissed and Sealed!

Recently, at the Los Angeles Superior Court in Van Nuys we successfully represented a client and vacated a Felony violation of Penal Code section 524-Attempted Extortion and a misdemeanor violation of Penal Code section 422-Criminal Threats for a Lawful Permanent Resident that was seeking to adjust his status to United States citizen. We litigated the Penal Code section 1473.7 because he did not meaningfully understand the immigration consequences of his plea and, thus, we were able to persuade the prosecutor and the court that the charges should be vacated and dismissed. Because the Penal Code section 524 was a felony the client was prohibited from owning or possessing a firearm. Since he is a Lawful Permanent Resident he is now eligible to own and possess a firearm. In addition to vacating and dismissing his convictions, we also were able to Seal his arrest record per Penal Code section 851.91 since he no longer had a conviction because they were vacated and dismissed. This was a complete win and an excellent result!
