In the San Bernardino County Superior Court, San Bernardino Courthouse, Mr. Escovar represented a client charged with violations of Penal Code section 273.5(a) - Domestic Violence as a misdemeanor, and Penal Code section 273a(b) - Child Endangerment as a misdemeanor. The incident involved our client striking and injuring his wife at a party in front of his children, he unfortunately consumed too much alcohol.
Once retained, Mr. Escovar advised the client to complete 30 Alcoholics Anonymous meetings and a 12 Hour Anger Management class. After three court appearances, Mr. Escovar was able to negotiate a reduction in charges. The new offer was a plea to a violation of Penal Code section 415 - Disturbing the Peace for a “Terminal” sentence. That means no probation and no fine. The DA was satisfied with the AA meetings and the Anger Management Class completion, and agreed to dismiss the more serious charges. This was a particularly fantastic result because the client was not a United States citizen. Had our client been convicted of the Domestic Violence charge, he would have lost his eligibility to lawfully immigrate into the United States. A fair and just result given consideration of all the relevant circumstances.
