Penal Code section 243(e)(1) Offense Record of Arrest Ordered Sealed Pursuant to Penal Code section 851.91!

Our office was previously retained to represent a client involved in an incident that resulted in her arrest for an alleged violation of Penal Code section 243(e)(1), “Battery on a Spouse/Girlfriend/Cohabitant” back in 2016. After she was arrested for the alleged offense, she hired our office to represent her on the matter. Back in 2016, we presented equities to the prosecution and, ultimately, no criminal charges were filed against our client.

Recently, our client reached out to our office seeking to know if there is anything that we can do to “clean up” her record from this incident. We advised her that Penal Code section 851.91 was recently enacted and would allow her to petition to seal her record of arrest. Our client was eligible for relief under this Section since her arrest never resulted in a conviction. She then retained our office to assist her with this relief.

After only three short weeks, our client’s Petition was granted, and the court ordered her record of arrest sealed! Now, our client will no longer need to worry about this arrest causing her any prejudice in the future!
