Penal Code section 243.4, Sexual Battery, Offense Dismissed at Arraignment!

Our office was recently retained to conduct an investigation pre-filing into allegations of sexual abuse of a minor. After months of diligent work, our client was charged with allegedly violating Penal Code section 243.4, “Sexual Battery,” instead of the intended Penal Code section 288, “Lewd Acts on a Minor” charge.

Prior to the arraignment on the matter, our office gathered equitable documentation from the client such as proof of employment, educational documents, and character reference letters. At the arraignment on the matter it became clear to the prosecution that they would be unable to prove their case and proceed on the matter and the case was dismissed.
