Office Conference Hearing Granted and No Filing of Criminal Charges for Our Client Charged with Violations of Penal Code Section 69 and 647(f)!

Our office was recently retained to represent a client involved in an incident that resulted in her arrest for violations of Penal Code section 69, “Resisting Arrest” and Penal Code section 647(f), “Drunk in Public”!

The incident appeared to be aberrant behavior that our client quickly sought to rehabilitate. Our client had no prior criminal convictions or contacts, volunteered at an animal shelter frequently, and has full-time employment. Our office provided the prosecution with an equity package documenting our client’s work history, volunteer efforts, attendance at Alcoholics Anonymous meetings and treatment for her mental health. We quickly provided this package to the prosecution requesting diversion or a “no filing” of criminal charges.

Our office was able to determine which prosecutor would handle the filing of charges for this matter and we provided additional documentation showing our client’s updated mental health treatment and character letters of reference to support our assertion regarding her behavior. The prosecution then offered our client an office hearing for this matter.

At the office hearing our client was given additional tasks she must complete to resolve the matter with a no filing of charges. We assisted our client with completing these requirements and the prosecution resolved the matter without filing charges.

This is a great result for our client, resulting in no filing of charges. Our client was facing a felony resisting arrest charge and will no longer have to face potential custody or conviction on her record!
