Penal Code section 664/496(a), Attempted Receiving Stolen Property Not Exceeding $950, Negotiated to Business and Professions Code section 23402, Purchase of Alcohol from Person Without Valid License!

Recently in Los Angeles County at the Bellflower Courthouse a Complaint was filed against our client alleging that he attempted to violate Penal Code section 496(a), Receiving Stolen Property not Exceeding $950.

It was alleged that during an undercover sting operation coordinated by Alcohol and Beverage Control (“ABC”), an undercover ABC agent offered to sell our client alcohol that the agent stated was stolen. Our client was cited after purchasing these bottles and a Complaint was later filed.

If our client was convicted of this charge, he would face immigration consequences. Our office presented a mitigation package to the prosecution and after strenuous negotiation with the prosecution they agreed to allow our client to plea to Business & Professions Code section 23402. This negotiation will prevent adverse immigration consequences for our client and is a great result.
