Juvenile Penal Code section 245(a)(4) Felony Charges – Welfare & Institutions Code § 790 Deferred Entry of Judgment Granted!

My client is currently seventeen (17) years old and is a senior in high school. She was charged with violating Penal Code section 245(a)(4) in which it was alleged that she dragged another female student by the hair and repeatedly hit and slammed her head to the concrete ground during an altercation at the high school. This altercation was videotaped, and the other student had to receive medical attention after the incident.

Our client was in the process of applying to colleges and had been accepted to multiple universities. We provided the prosecution with a mitigation package that showed that our client had no prior contact with law enforcement, would be attending a university in the fall, was receiving great grades, and was involved in her church and volunteer work.

After sending multiple updated mitigation packages with information regarding our client’s good behavior and future plans to pursue her education, the prosecution agreed to allow our client to complete a Deferred Entry of Judgment program pursuant to Welfare and Institutions Code section 790. If our client successfully completes the program, the record of the arrest and the charges will be wiped clean and it will be as though the arrest never occurred.

This is a great result given the charged offense and the circumstances of the allegations! This result will protect our client’s future education and career goals
