Misdemeanor Penal Code section 647(f) Public Intoxication Offense Dismissed and Renegotiated to an Infraction Penal Code section 415(2) Offense! No Jail/Only Fine!

Recently at the Pasadena Courthouse in the Los Angeles County, I was able to get a reduction of a misdemeanor Penal Code section 647(f) Public Intoxication Offense to an infraction Penal Code section 415(2) Disturbing the Peace offense.

My client is a network security analyst for a high-powered corporation and did not want a misdemeanor conviction to negatively impact his career and future job opportunities. Thus, we suggested that our client voluntarily enroll in Alcoholic Anonymous classes and a Substance Abuse Treatment Program.

After our client had completed a significant amount of alcohol education and treatment classes, we received documented proof and attached it to a mitigation package that we provided to the prosecution. In that mitigation package we also included proof of our client’s employment, letters of recommendation, and his volunteer work.

The prosecution acknowledged that our client had completed much more than he would have asked our client to complete to address the offense. Therefore, we negotiated for the prosecution to allow our client to plead to the infraction offense for a fine.

With this result, our client limited the negative impact the offense could have on his job and avoided any jail or community labor the prosecution may have wanted him to complete for the misdemeanor offense.
