Another Penal Code Section 1016.5 Motion - Granted - Vacated, Health and Safety Code 11352(a) Conviction

At the Clara Shortridge Foltz Criminal Courts Building I litigated a Penal Code section 1016.5 Motion. We conducted a thorough investigation regarding whether my client was properly advised of the immigration consequences of his plea, prior to the plea. Our investigation revealed that the record was lacking in such proof. I filed and litigated the motion. After a contested hearing, the judge granted the motion to vacate the plea. Since the plea was vacated, my client is now eligible for immigration relief. It feels great to make a difference in our clients' and their families lives!
