Common Drug Charges

Some more severe than others, drug crimes are defined and punished uniquely. Some of the most common drug crimes are:

Drug paraphernalia possession: This crime refers to the ownership or possession of paraphernalia for drug use, i.e. bongs, crack pipes, syringes, etc. As these items are not illegal to own outright, the court must prove that their sole use was drug-related.

Drug possession: This is when someone knowingly and willfully possesses an illegal controlled substance. Because possession charges also refer to ownership or access to illegal substances, the drugs do not have to be on your person at the time of the arrest. The court categorizes the crime as either simple possession or possession with the intent to distribute.

Drug trafficking: Also known as distribution, trafficking charges refer to the transportation, sale, or import of illegal controlled substances. This crime is a larger, organized version of the distribution charges associated with some possession cases. The offense typically involves importing drugs, distributing to dealers, and employing an entire production line. Drug trafficking is one of the most severe drug crimes.

Drug manufacturing: This crime refers to the production, creation, or cultivation of an illegal substance. You can face manufacturing charges for purchasing items with the intent to create drugs, or for offering to help in the production process.

Drug Conviction Sentences

You can face a variety of sentences for your drug crime. Some are less severe misdemeanors, such as paraphernalia possession and drug possession. You can face up to 1 year of jail time and up to a $500 fine for each of these misdemeanors. Drug trafficking, on the other hand, is a felony. If you are convicted of trafficking, you can face up to in life in prison.
