Misdemeanor Child Annoy or Molest Charges Dismissed, Plea Agreement to related offense, No Sex Registration

At the Long Beach Superior Courthouse, I recently resolved a case where my client was accused of Annoying or Molesting a 12 year old boy. He was charged with a misdemeanor violation of Penal Code section 647.6(a). If convicted of that offense, he would have to register for life as a sex offender under Penal Code section 290. The prosecutor was also seeking 30 days of jail. This initial offer would have caused my client to be convicted of a sex offense involving a minor, would have required sex registration for life, 30 days of jail, and deportation (since he was present in the United States on a Temporary Status). I was able to successfully negotiate with the prosecutor. Since the charge involved a specific intent relating to the sexual intent, and since my client was very intoxicated, I was able to reach a plea agreement with the prosecutor for a related charge that did not require sex registration and I was able get community labor instead of jail time. The client and his relatives were extremely grateful for the result that we achieved.
