Underage DUI in Pasadena, CA

In California, most adults are considered to be driving under the influence if they have a blood alcohol content of at least 0.08%. For those under 21, however, there is very little required to be arrested for DUI. If these individuals are convicted, they face particularly harsh penalties which can impact their present and future.

Zero Tolerance For Under-21 DUI

California has a Zero Tolerance law for underage DUI, which means these individuals can face charges if they have a blood alcohol content of at least 0.01%. Depending on how much alcohol was in their system, California residents and visitors under the age of 21 can actually be charged three different DUI offenses:

  • Zero Tolerance Law – BAC of at least 0.01%
  • Vehicle Code 23140 – BAC of at least 0.05%
  • Vehicle Code 23152B – BAC of 0.08% or more

While you may only be convicted of one of these offenses, these laws make it much easier for prosecutors to get a conviction. Violation of the Zero Tolerance law is a traffic infraction rather than a criminal offense, but can result in a one year suspension of your driver’s license.

Other Related Charges

In addition to DUI and Zero Tolerance charges, underage drinkers can be charged with a wide range of additional offenses depending on the circumstances of the arrest. These include, but certainly are not limited to:

  • Underage possession of alcohol in a vehicle
  • Refusing to take a chemical BAC test
  • Minor in possession
  • Contributing to the delinquency of a minor
